WAYS TO IMPROVE YOUR ODDS WITH A DISABILITY CLAIM

Many people get diagnosed with a disabling medical condition and their doctor tells them to file for disability.  The doctor may even say that you are disabled and should have no problem getting benefits.  Imagine how frustrating it is then to be denied and told that you don't qualify.  It happens all the time.

Social Security's definition of Disability is very narrow.  There are several conditions one has to meet before benefits will be approved.

There are some things you should know that will improve your chances of getting disability benefits.

1.  Most people do not get approved with an application.  About 8 out of 10 applications are denied.  It usually takes two (2) appeals to have a chance of approval.  So, you must be prepared to stay the course over a period of months, or even years, to get approved.

2.  All unfavorable decisions must be appealed within 60 days.  After that, the case is dead.

3.  Return all forms on time and keep appointments on time, including any exams they schedule for you.

4.  Try to get your doctor to explain in writing (and in great detail) why you are not able to work.  There's a form for this called a Medical Source Statement.  It isn't enough to say, "This patient is disabled due to (disease) and can't work."  Detail, detail, detail.  What are the functions that limit the patient (sitting, standing, walking, bending, lifting, etc.).

5. Comply with medical treatment.  See your doctor, take prescribed medications as directed, follow through with physical therapy or other treatments prescribed.  Social Security will not understand why you don't do so, even if you think you have a good reason for not doing so.

6.  Consider getting some help with your case, especially after a denial.  You can only do so much by yourself, then it's time for professional help.
